A 31-year-old woman who admitted to having sex with a 13-year-old boy and then become pregnant with his child will not face jail time.
Andrea Serrano of Fountain, Colorado initially faced sexual assault charges after she was arrested in July 2022, but in early 2023 she accepted a plea deal that would keep her out of jail.
The victim’s family believes the suspect was shown compassion because she’s a woman.
“I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her,” the victim’s mother told KKTV.
According to police, an investigation into the sexual assault of a 13-year-old began in June 2022. Officials learned that Serrano, who the victim viewed as a “mother figure,” was having a sexual relationship with the minor.
She was charged with sexual assault against a child and sexual assault against a child under the age of 15 by one in a position of trust.
Serrano, who became pregnant and later gave birth to a baby boy, admitted to the crime.

Prior to the suspect accepting the plea deal, the victim’s mother expressed her displeasure to the judge.
“She (Serrano) sexually assaulted my 13-year-old son … She introduced him to drugs, she needs to be in jail,” she said. “It’s a double standard. If she was a man, and my son was a girl she (Serrano) would be behind bars right now.”
The objection did not matter. Rather than jail, Serrano will be required to register as a sex offender and she will face 10 years to life on sex offender intensive supervised probation.
The victim’s family is far from satisfied, and they are already looking at the next steps they can take in order for the 13-year-old to gain custody of his child.
Currently, Serrano is out of custody on bond and has been caring for the baby.
“I feel like my son is robbed of his childhood. Now he’s having to be a father. He’s a victim, and he’s going to have to live with that for the rest of his life.”
No words can even begin this horrific situation. This woman should face jail time no ifs, ands, or buts.
